RE Signature Services Terms and Conditions

Please read these Terms and Conditions ("Terms") carefully before scheduling or receiving any service from RE Signature Services LLC ("RE Signature Services LLC," "we," "us," or "the Notary"). By scheduling an appointment, requesting a service, or making a payment, you ("Client," "you") agree to be bound by these Terms in full.

These Terms constitute a legally binding agreement between you and RE Signature Services LLC. If you do not agree to these Terms, do not schedule or accept services from RE Signature Services LLC.

RE Signature Services LLC holds both a New Jersey notary public commission and separate ordained/certified clergy credentials. Where a service (such as marriage solemnization) is performed under clergy authority rather than notary authority, these Terms identify that distinction explicitly.

1. Services Offered

RE Signature Services LLC provides professional notary, signing, verification, fingerprinting, wedding officiant, and related support services by appointment.

- Remote Online Notarization (RON)

- Loan Signing Services

- Estate Plan Signing Services

- I-9 Verification Services

- Ink Fingerprinting Services

- Wedding Officiant Services

RE Signature Services LLC reserves the right to decline, limit, or discontinue any service listed above at its sole discretion, including refusal of a specific request prior to or at the appointment.

2. Fees, Deposits, and Payment

2.1 Booking Deposits and Payment

Payment terms may vary based on the service, client, or agreed-upon arrangement. A booking deposit may be required to secure an appointment and, when required, will be applied toward the total service fee.

Unless otherwise agreed in writing, any remaining balance is due prior to services being rendered. Approved business and professional clients, including attorneys, title companies, signing services, and other organizations, may be invoiced according to separately agreed-upon payment terms.

If a requested service cannot be completed because the Client fails to satisfy the applicable requirements for that service, any refund of amounts paid will be governed by these Terms and Conditions.

2.2 Third-Party and Pass-Through Costs

Certain services involve fees charged by third-party agencies, courts, or government offices. These fees are separate from RE Signature Services LLC's service fees, are the responsibility of the Client, and are non-refundable once submitted to the applicable third party, regardless of the outcome or processing time.

2.3 Accepted Payment Methods

RE Signature Services LLC accepts payment by cash, credit/debit card, certified check, and mobile payment applications (including Venmo and Zelle). Payment method availability may vary by appointment and will be confirmed at booking.

2.4 Rate Disclosure

Current rates for each service are provided to the Client at the time of booking and, where applicable, in a separate fee schedule. RE Signature Services LLC reserves the right to update its rates at any time; the rate confirmed at booking will apply to that appointment.

3. Cancellation and Rescheduling Policy

Clients must provide at least 24 hours' advance notice to cancel or reschedule a confirmed appointment.

Cancellations or rescheduling requests made 24 hours or more before the scheduled appointment: The booking deposit may be refunded or applied to one rescheduled appointment at the Client's election.

Cancellations, rescheduling requests, or no-shows made less than 24 hours before the scheduled appointment: The booking deposit is forfeited.

Wedding officiant services may require advance preparation, scheduling, travel planning, and reservation of the ceremony date and time. Once reserved, the date and time are held exclusively for the Client. Booking deposits for wedding officiant services remain non-refundable.

If RE Signature Services LLC must cancel or reschedule an appointment: The booking deposit will be refunded or applied to a rescheduled appointment at the Client's election.

Clients who are more than 15 minutes late without prior communication may be considered a no-show. In such cases, the appointment may be cancelled or rescheduled at RE Signature Services LLC's discretion, and the booking deposit will be handled in accordance with this Section.

RE Signature Services LLC recommends confirming appointment details in writing (text or email) to avoid misunderstandings regarding timing and location.

4. Identification Requirements for Notarial Services

For services involving a notarial act, each signer must provide satisfactory identification as required by applicable New Jersey law.

RE Signature Services LLC will not perform a notarial act if the Client cannot provide identification that RE Signature Services LLC, in its professional judgment, determines to be satisfactory. If a requested service cannot be completed because satisfactory identification is not provided, any fees, charges, or refunds shall be governed by Sections 2 and 3 of these Terms.

5. Client Responsibilities

Clients are responsible for:

- Providing accurate contact, appointment, service, and location information;

- Being present and prepared at the scheduled appointment time;

- Providing all documents, identification, forms, licenses, instructions, or other materials required for the selected service;

- Confirming any requirements imposed by an employer, attorney, title company, government agency, licensing authority, receiving organization, or other third party before the appointment;

- Ensuring all required individuals, signers, witnesses, or participants are present when applicable;

- Providing accurate information necessary for RE Signature Services LLC to perform the requested service; and

- Paying all applicable deposits, service fees, travel fees, third-party costs, and other agreed-upon charges.

Clients are responsible for reviewing and understanding any documents, forms, instructions, or requirements associated with the service they request. RE Signature Services LLC is not responsible for errors, omissions, delays, rejections, or additional costs resulting from inaccurate or incomplete information provided by the client or a third party.

Additional responsibilities and requirements may apply depending on the service selected, as described in Section 7 of these Terms and Conditions.

6. Right to Refuse or Decline Service

RE Signature Services LLC, in its capacity as a service provider and, when applicable, a New Jersey notary public, reserves the right to refuse or decline any requested service, including but not limited to circumstances where:

- The Client cannot provide satisfactory identification;

- RE Signature Services LLC has a reasonable belief the signer is not signing knowingly, voluntarily, or is being coerced;

- The document appears incomplete, fraudulent, or the request otherwise falls outside the scope of RE Signature Services LLC’s legal authority;

- The Client fails to satisfy the requirements applicable to the requested service or fails to provide required documents, forms, licenses, instructions, or other necessary materials;

- Performing the requested act would violate New Jersey law, RE Signature Services LLC’s notary commission, or any other applicable law or professional standard;

- The appointment location or circumstances present a safety concern to RE Signature Services LLC.

If RE Signature Services LLC declines to perform a service after arrival for the reasons above, any refund of amounts paid shall be governed by Sections 2 and 3 of these Terms.

7. Service-Specific Terms

7.1 Mobile Notary Services

RE Signature Services LLC provides mobile notary services at mutually agreed-upon locations throughout New Jersey, subject to availability. Travel and other service-related fees may apply based on location, distance, scheduling, or additional requests.

Signers must personally appear before the notary, provide acceptable identification, and meet all requirements for the requested notarial act. RE Signature Services LLC reserves the right to decline a notarization when legal or identification requirements cannot be satisfied.

Clients are responsible for providing complete documents and confirming the type of notarization, witness requirements, and any requirements of the receiving party. RE Signature Services LLC does not prepare or interpret legal documents, select notarial acts, or provide legal advice.

Witness coordination may be available upon advance request for an additional fee.

All notarizations are performed in accordance with applicable New Jersey notary laws and requirements.

7.2 Remote Online Notarization (RON)

Remote online notarizations are performed only when permitted by applicable law and through an approved remote online notarization platform.

Clients are responsible for ensuring they have:

- A stable internet connection;

- A device equipped with a working camera and microphone;

- Valid government-issued identification that satisfies applicable identity-proofing requirements; and

- The technical ability to successfully complete any required identity verification or credential analysis.

Failure to satisfy identity verification requirements or platform security requirements may result in termination of the appointment. No notarization can proceed unless all applicable identity verification and credential analysis requirements have been successfully completed. Standard appointment and cancellation policies remain applicable.

RE Signature Services LLC is not responsible for interruptions caused by the client's internet connection, hardware, software, or failure of the approved RON platform's identity verification process.

7.3 Loan Signing Services

RE Signature Services LLC provides professional loan signing services for various real estate and mortgage transactions, including purchases, refinances, HELOCs, seller packages, reverse mortgages, loan modifications, and other signing assignments.

Loan signing services may be performed through mobile/in-person appointments or Remote Online Notarization (RON), when the transaction is eligible for remote execution and RON has been authorized by the applicable hiring entity and other parties to the transaction.

RE Signature Services LLC acts solely as a notary signing professional and does not provide legal, financial, lending, or real estate advice. Questions regarding loan terms, document contents, or the transaction must be directed to the appropriate lender, title company, attorney, or hiring entity.

7.4 Estate Plan Signing Services

RE Signature Services LLC facilitates the execution of estate plan documents, including but not limited to trusts, wills, powers of attorney, advance healthcare directives, and related documents.

Services may include performing authorized notarial acts, witnessing signatures when requested, coordinating or providing witnesses when requested and available, and returning completed documents in accordance with the hiring entity's or Client's instructions, as applicable. Witness services are subject to availability and may incur additional fees.

RE Signature Services LLC does not prepare estate planning documents, determine whether a document requires notarization or witnesses, interpret legal documents, or provide legal advice. Clients are solely responsible for obtaining legal advice from their attorney and ensuring all required signers, witnesses, and documents are present at the appointment.

7.5 I-9 Verification Services

Form I-9 verification is not a notarial act. When providing I-9 verification services, RE Signature Services LLC acts solely as the employer's designated authorized representative and not in the capacity of a notary public.

When acting as an authorized representative for Form I-9 purposes, RE Signature Services LLC's role is limited to reviewing the documents presented by the employee and completing Section 2 (or other applicable sections) of Form I-9 in accordance with the employer's instructions.

RE Signature Services LLC does not determine employment eligibility, provide immigration or legal advice, or represent U.S. Citizenship and Immigration Services (USCIS) or any government agency. The employer remains solely responsible for compliance with all applicable federal employment eligibility verification laws.

7.6 Ink Fingerprinting Services

RE Signature Services LLC provides traditional ink fingerprinting on physical fingerprint cards, including FD-258 cards. RE Signature Services LLC does not provide Live Scan or electronic fingerprint transmission unless expressly stated otherwise.

Clients are responsible for confirming before scheduling that the requesting agency or organization accepts physical fingerprint cards and for determining the specific card type, format, and submission requirements applicable to their request.

RE Signature Services LLC is not a law enforcement agency, background check provider, or licensing authority and does not determine whether fingerprint cards satisfy the requirements of any employer, licensing board, government agency, or other requesting organization.

Fingerprint quality may be affected by factors beyond RE Signature Services LLC's control, including age, skin condition, scars, dryness, or worn fingerprints. RE Signature Services LLC does not guarantee acceptance of completed fingerprint cards by any requesting entity. If reprinting is requested and available, additional fees may apply.

7.7 Wedding Officiant Services

Capacity Clarification: Wedding officiant services are performed solely in the owner's separate capacity as an ordained minister authorized to solemnize marriages under N.J.S.A. 37:1-13 and not under the authority of a New Jersey notary public commission.

Scope of Service: Wedding officiant services may include marriage license signing, intimate elopement ceremonies, traditional wedding ceremonies, customized ceremony scripts, personalized vows (when selected), rehearsal attendance (when included in the selected package), coordination regarding ceremony logistics, completion and signing of the marriage license following the ceremony, and returning the completed marriage license to the appropriate issuing municipality in accordance with applicable New Jersey law. The specific services provided will depend on the package selected by the Clients and any additional services agreed upon in writing.

Clients are solely responsible for obtaining a valid New Jersey marriage license, presenting the license at the appointment, providing any legally required witnesses, and complying with all applicable marriage license requirements, including issuance, waiting periods, and expiration.

RE Signature Services LLC is not responsible for delays, invalid licenses, or the inability to perform the ceremony resulting from the Client's failure to satisfy applicable legal requirements.

Deposits, payment, cancellations, and rescheduling are governed by Sections 2 and 3 of these Terms.

8. No Legal Advice

We are not attorneys licensed to practice law and may not give legal advice about immigration, marriage or any other legal matter or accept fees for legal advice.

Clients requiring such advice should consult a licensed attorney.

9. Limitation of Liability

To the fullest extent permitted by New Jersey law, RE Signature Services LLC’s total liability arising out of or related to any service performed under these Terms (whether based in contract, tort, negligence, strict liability, or any other legal theory) shall not exceed the total fees actually paid by the Client to RE Signature Services LLC for the specific appointment giving rise to the claim. In no event shall RE Signature Services LLC be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of income, business interruption, or missed deadlines, whether or not RE Signature Services LLC has been advised of the possibility of such damages.

This limitation does not apply to liability that cannot be limited or excluded under applicable New Jersey law, including liability for RE Signature Services LLC’s own fraud, willful misconduct, or gross negligence.

10. Indemnification

Client agrees to indemnify and hold harmless RE Signature Services LLC from and against any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of: (a) inaccurate, false, or fraudulent information or identification provided by the Client; (b) the Client's misuse of any notarized or completed document; or (c) the Client's breach of these Terms.

11. Confidentiality and Recordkeeping

RE Signature Services LLC will maintain a notary journal and related records as required by New Jersey law and will handle Client documents and personal information with reasonable care and discretion. RE Signature Services LLC may be required by law to retain records of notarial acts and to produce such records in response to a valid subpoena, court order, or law

enforcement request.

12. Force Majeure

RE Signature Services LLC is not liable for delays or failure to perform due to causes beyond its reasonable control, including severe weather, accidents, illness, government restrictions, or other events of force majeure. In such cases, RE Signature Services LLC will make reasonable efforts to reschedule and will refund any amounts paid or, at the Client's election, apply those amounts toward a rescheduled appointment.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or RE Signature Services LLC services shall be subject to the exclusive jurisdiction of the state or federal courts located in New Jersey, and each party's consent to personal jurisdiction and venue therein.

14. Modifications to These Terms

RE Signature Services LLC may update these Terms from time to time. The version of these Terms in effect at the time of booking will govern that appointment. Continued use of RE Signature Services LLC services after any update constitutes acceptance of the revised Terms.

15. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with any signed engagement or fee schedule provided at booking, constitute the entire agreement between Client and RE Signature Services LLC regarding the services described herein, superseding any prior oral or written understandings.
